1. Seller and scope
Publisher and operator: Mathis Ghislain Delolmo, French sole trader (entrepreneur individuel / EI), trading as BIOMECASE and operating the MOTIONEST service — 17 avenue Gambetta, 69250 Neuville-sur-Saône, France — SIREN 947 914 800 — SIRET 947 914 800 00018 — intra-community identifier FR68947914800 — +33 7 49 35 64 79 — contact@motionest-video.com. According to the publisher’s declaration, the business uses the French VAT exemption scheme: VAT not applicable under article 293 B of the French General Tax Code. The publisher confirmed active trading under the BIOMECASE name on 13 August 2026.
These terms apply to one-off creations and optional monthly memberships ordered exclusively by business customers for professional purposes. A one-off creation can be purchased without an account or company form; by accepting these Terms, the customer confirms they act for business purposes and have the necessary authority. A free account is still required for the multi-device library, welcome discount and memberships. A bespoke quote may include clearly accepted project-specific terms.
2. Service characteristics
MOTIONEST enhances images and generates personalised photos or videos from customer files, choices and instructions. Media type, length, definition, platform, reference count and options are summarised before payment.
AI output is variable: identical inputs may produce different results. Demos illustrate possibilities and do not guarantee an identical reproduction. MOTIONEST remains responsible for the contractual characteristics shown before payment.
3. Customer files and approval
Customers warrant that they hold the necessary rights and permissions for photos, logos, brands, works and recognisable people. They must not upload unlawful or unauthorised confidential content or use the service to misrepresent a property, product or service.
After payment, photo enhancement and video generation run automatically. Customers review accuracy, text, rights and visible characteristics before publishing the delivered result.
4. Order process
Before payment, customers can correct choices and see a summary of characteristics, full total, one-off or recurring nature and links to these Terms and the Privacy Policy.
An order becomes binding after acceptance of the Terms, confirmation of business use, authorisation of immediate processing and use of a button clearly stating the obligation to pay. Stripe collects the email address needed for a receipt when a one-off purchase is made without an account. Confirmation is linked to the order and, where an account exists, available from the library.
5. Price, VAT and promotions
Prices are shown in euros at checkout. Length, quality and extra photos can change the total before confirmation. Under the tax regime declared by the publisher, VAT is not charged: ‘VAT not applicable — article 293 B of the French General Tax Code’. The displayed amount is therefore the amount payable, apart from any fee imposed directly by a payment provider.
When eligibility is displayed, the 10% welcome discount applies automatically to the first one-off purchase. It does not combine with a membership benefit unless the summary expressly says so.
A valid Stripe promotion code may be entered on the payment screen. Its eligibility, duration, applicable products and combination rules are those configured for that code; Stripe shows the reduced total before confirmation.
6. One-off payment
A one-off creation never starts a membership. Stripe charges the displayed total once after confirmation. MOTIONEST does not receive full card details.
7. Optional memberships
Essential: €29/month with €35 creation balance. Regular: €59/month with €75 balance. Active: €119/month with €150 balance. Video equivalents are estimates because length, definition and reference count change usage.
Membership renews monthly until cancelled, with no annual commitment. Accumulated balance is capped at three monthly grants. The current product does not apply a rolling three-month expiry, so no such claim is made. Balance already granted is not removed when renewal stops and remains visible in the account.
8. Processing and delivery
Processing begins after payment confirmation and receipt of required files. Displayed timing is an estimate and may vary with provider load, length, definition and checks. Delivery is made available in the library and/or by download link.
Most creations may complete within minutes, but timing is not guaranteed. Customers should retain local copies of important files.
9. Business orders and immediate processing
MOTIONEST accepts only orders placed for professional purposes. The fourteen-day withdrawal right that may apply to consumers therefore does not apply to these B2B orders.
The business customer separately authorises personalised processing to begin immediately after payment confirmation. Before processing starts, the customer may contact MOTIONEST; any cancellation depends on the actual processing status and these Terms.
10. Contractual conformity
MOTIONEST supplies the duration, definition, media type and options shown in the order summary, subject to the creative variability inherent in AI and the quality of files supplied.
A business customer must report an established technical non-conformity promptly and identify the affected project. MOTIONEST will correct, rerun or provide a proportionate remedy based on the defect and processing status.
11. Technical failure
If a paid creation is not delivered because of a confirmed technical failure, the business customer may request a rerun. If a rerun is impossible, MOTIONEST provides a proportionate remedy, which may include account balance or a refund depending on processing status.

12. Cancelling renewal
Renewal can be stopped free of charge from the clearly labelled account control. Cancellation takes effect at the end of the paid period unless mandatory law provides otherwise. MOTIONEST confirms receipt, effective date and effects on a durable medium. No further monthly charge is made after that date.
13. Use of delivered content
Subject to third-party rights, provider terms and applicable law, delivered content is intended for the commercial and social uses described at order. MOTIONEST does not guarantee exclusivity, registrability or freedom from claims where customer inputs infringe third-party rights.
14. B2B complaints and disputes
Business complaints: contact@motionest-video.com. The parties first seek a documented amicable solution.
If no agreement is reached, French law applies and jurisdiction is determined under the rules governing business-to-business contracts. Consumer mediation does not apply to exclusively B2B orders.
