CONTRACTUAL INFORMATION

Sales and membership terms

1. Seller and scope

Publisher and operator: Mathis Ghislain Delolmo, French sole trader (entrepreneur individuel / EI), trading as BIOMECASE and operating the MOTIONEST service — 17 avenue Gambetta, 69250 Neuville-sur-Saône, France — SIREN 947 914 800 — EU VAT number FR68947914800 — +33 7 49 35 64 79 — contact@nettoyage-propre-lyon.com. The publisher confirmed active trading under the BIOMECASE name on 13 August 2026. The active establishment number will be added after documentary verification and before payments are enabled.

These terms apply to one-off creations and optional monthly memberships ordered through MOTIONEST by consumers and businesses. Mandatory consumer rights remain unaffected. A bespoke quote may include clearly accepted project-specific terms.

2. Service characteristics

MOTIONEST enhances images and generates personalised photos or videos from customer files, choices and instructions. Media type, length, definition, platform, reference count and options are summarised before payment.

AI output is variable: identical inputs may produce different results. Demos illustrate possibilities and do not guarantee an identical reproduction. This does not limit statutory conformity rights.

3. Customer files and approval

Customers warrant that they hold the necessary rights and permissions for photos, logos, brands, works and recognisable people. They must not upload unlawful or unauthorised confidential content or use the service to misrepresent a property, product or service.

Customers approve enhanced images before video generation and review accuracy, text, rights and visible characteristics before publishing.

4. Order process

Before payment, customers can correct choices and see a summary of characteristics, full total, one-off or recurring nature and links to these Terms and the Privacy Policy.

An order becomes binding after acceptance of the Terms, any separately required request for immediate performance and use of a button clearly stating the obligation to pay. Confirmation is retained in the account and/or provided on a durable medium.

5. Price, tax and promotions

Prices are those shown in euros at checkout. Length, quality and extra photos can change the total before confirmation. Tax-inclusive wording must match the actual Stripe tax configuration and invoice.

When eligibility is displayed, the 10% welcome discount applies automatically to the first one-off purchase. It does not combine with a membership benefit unless the summary expressly says so.

6. One-off payment

A one-off creation never starts a membership. Stripe charges the displayed total once after confirmation. MOTIONEST does not receive full card details.

7. Optional memberships

Essential: €29/month with €35 creation balance. Regular: €59/month with €75 balance. Active: €119/month with €150 balance. Video equivalents are estimates because length, definition and reference count change usage.

Membership renews monthly until cancelled, with no annual commitment. Accumulated balance is capped at three monthly grants. The current product does not apply a rolling three-month expiry, so no such claim is made. Balance already granted is not removed when renewal stops and remains visible in the account.

8. Processing and delivery

Processing begins after payment confirmation and receipt of required files. Displayed timing is an estimate and may vary with provider load, length, definition and checks. Delivery is made available in the library and/or by download link.

Most creations may complete within minutes, but timing is not guaranteed. Customers should retain local copies of important files.

9. Withdrawal and immediate performance

Consumers normally have a fourteen-day withdrawal period for a distance contract. Where immediate personalised performance is requested, MOTIONEST separately collects an express, unchecked request and the statutory acknowledgment, then confirms it on a durable medium.

A free function at /en/legal/withdrawal lets customers submit a declaration, review it before confirmation and download a timestamped receipt. Without the legally required request, acknowledgment and confirmation, statutory rights remain unchanged.

10. Statutory conformity rights

Consumer purchases of digital content and services carry statutory conformity rights. For one-off supply, the professional may be liable for lack of conformity appearing within two years of supply; for continuous supply, throughout the contracted period.

Consumers may request conformity without cost and unjustified delay and, where legislation provides, a price reduction or termination. These rights are not limited by a commercial rerun or refund policy.

11. Technical failure

If a paid creation is not delivered because of a confirmed technical failure, the customer may request a rerun. This commercial remedy does not limit statutory conformity, price reduction or termination rights.

12. Cancelling renewal

Renewal can be stopped free of charge from the clearly labelled account control. Cancellation takes effect at the end of the paid period unless mandatory law provides otherwise. MOTIONEST confirms receipt, effective date and effects on a durable medium. No further monthly charge is made after that date.

13. Use of delivered content

Subject to third-party rights, provider terms and applicable law, delivered content is intended for the commercial and social uses described at order. MOTIONEST does not guarantee exclusivity, registrability or freedom from claims where customer inputs infringe third-party rights.

14. Complaints, mediation and disputes

Complaints: contact@nettoyage-propre-lyon.com. After a prior written complaint, a consumer may use the consumer mediator designated by the business free of charge.

The appointed mediator’s name, address and website must be added after effective registration; none is invented here. French law applies subject to mandatory law in the customer’s country of residence and consumer-protective jurisdiction rules.
